Ready to rent a scooter to zip around Key West? Great idea! Before you rent that scooter you need to be sure you know the rules of the road. 

There are two classifications of scooters in the state of Florida: motor scooters, and motorized scooters. The basic difference is motor scooters have a saddle or a seat, and motorized scooters don’t. To be considered a motorized scooter, the vehicle must have three wheels or less, may not exceed a speed of 30 miles-per-hour, and does not have a seat, or saddle. (You are in a standing position when you ride.) With a seat, it is considered a motor scooter. 

In Florida, motorized scooters are not street-legal, which means they can’t be operated on sidewalks or roads. On the other hand, Florida does allow counties and cities to make their own rules when it comes to motorized scooters. The only caveat is that the federal law is followed, which allows a maximum speed of 15 miles per hour. Motorized scooters aren’t required to be registered, and you are also not required to wear a helmet if you are 16 or older. (Though it is highly recommended.) You do, however, need to be a valid driver’s license to operate a motorized scooter in Florida. 

If you are driving a motor scooter (with a seat or saddle), in Florida it is street-legal and may be operated on the road, as long as it has been registered. A title and license plate are also required. You are not allowed to drive on highways, because most motor scooter engines are designed for a 40 mph maximum speed. You need to be at least 16 years old to drive a motor scooter, along with having a valid driver’s license. The same laws that apply to other vehicles on the road, apply to motor scooters. This includes driving under the influence of alcohol, speed limits, etc.
